By accepting the terms and conditions of this website, you as a bidder, buyer or seller acknowledge that you are entering into a legal and binding contract between you and the Seller.  You agree to abide by all terms and conditions.

Responsible for purchases

By placing a bid, you acknowledge that your bid is a legally binding offer to purchase the lot you are bidding on.

Do you agree to allow Pelton Livestock to use your personal data?

I consent to allowing Pelton Livestock to capture and use my personal data. I understand and have read the Privacy Policy and understand that I may revoke this consent at any time.

Bidder/User Registration and Responsibility

You must be 18 years or older to register and bid. Buyers (a.k.a. users) must register to participate. Establishing a user account or bidding or buying at this auction/sale acknowledges bidders’ consent to the terms and conditions as outlined below. Bidders will be solely responsible for any and all actions taken with their bidding account including all purchase amounts, freight, and any costs associated with collecting same.

During the registration process, you must submit information found to be current, complete, and accurate for proper identification.  You acknowledge that it is your responsibility to continually maintain current and accurate account information.  All bids and sales are final and cannot be retracted or removed.

Pelton Livestock online auctions require you to enter a valid credit card to register and bid.  Your credit card will be checked for an available credit of $25.  Your card will not be charged at this time.

You acknowledge that it is your responsibility to securely save all auction registration and login information including usernames and passwords.  You accept responsibility and payment for all purchases from your account.

Reserve Price

An auction lot may have a reserve price.  The reserve price is the lowest price at which the lot will be sold.  The reserve price is never disclosed to bidders, but a note may be displayed in the lot information screen specifying a reserve price.  When the reserve price has been met the screen may read "reserve price met".  The lot will then be sold to the highest bidder at the conclusion of the online auction sale.  If the reserve price is not met, the lot will not be sold during that online auction.  

Bidding Eligibility

Anyone is eligible to participate, but the seller(s) and/or Pelton Livestock reserves the right to reject any and all bids unless otherwise stated. On items selling with reserve, the seller and/or Pelton Livestock has the right to bid on behalf of the seller at an amount not to exceed the reserve price. Reserve prices need not be stated prior to or during the auction.

Invoicing and Payment

All winning bidders will receive invoices immediately following the close of each auction. Invoices will be sent via electronic mail (when a working address is provided). Payment for purchases is due prior to removal or delivery of purchases unless prior arrangements have been made with the seller(s). Payments to be made directly to the seller(s). 

Personal Data

Pelton Livestock and its partners will not sell users personal data to any other entity nor use it for any reason other than that which is directly related to this auction and/or the promotion future auctions. Users consent to allow Pelton Livestock to capture and use their personal data for these purposes. Users may revoke this consent at any time by sending instructions via electronic mail to info@billpelton.com.

Currency Type

All bidding increments and payments will be in US Dollars (USD).


All animals and merchandise will be at the buyer’s risk as soon as bid off but will be cared for by the seller(s) for a reasonable amount of time during and immediately following the sale. Neither the owners, auction hosts, Auction Company, auction manager or other affiliated auction personnel may be held responsible for any accidents that may occur. It is to be clearly understood that Pelton Livestock and its agents and representatives act only as a medium between buyer and seller, and may not be held liable, financially or otherwise, for any failure on the part of the same to fulfill any obligations set forth in this sale or for the truth of any warranties expressed or implied. Neither does Pelton Livestock assume any financial obligations to collect or enforce the collection of monies between buyer and seller. Auction catalogs and information have been prepared by the Pelton Livestock from information provided by the seller(s) and is assumed accurate as presented. However, Pelton Livestock will in no way guarantee age, pedigree, or reproductive status of the animals selling. All exceptions taken and adjustments made are between buyer and seller.

Internet, Server & Software Issues

You acknowledge that the internet may be an unreliable and error-prone network.  Pelton Livestock will not be responsible for technology disruptions, errors or failures including disruptions to bidding or failure to execute recognized or unrecognized online bids.  Regardless of whether it is caused by a loss of connectivity or breakdown of the system, hacking or other reasons.  Pelton Livestock reserves the right, upon technology disruption, to continue, cancel or suspend the auction.

Governing Law

This agreement shall be interpreted in accordance with and governed by the laws of the State of Montana, to include but not limited to, the Uniform Commercial Code, as adopted in Montana.  The exclusive jurisdiction and venue of any controversy or claim arising from this contract will be in the County of Stillwater in the State of Montana.  If litigation is filed to enforce the terms of this agreement, the losing party in such litigation is responsible to pay the litigation costs and reasonable attorney’s fees incurred by the prevailing party.

Term of Agreement

The term of this agreement will begin on the date of acceptance of this agreement by bidder, buyer or seller and will remain in full force and effect until completion of this agreement.  This agreement, which may be amended in writing and signed by both parties, represents the entire agreement, and takes place of all prior agreements.


Pelton Livestock, LLC is not responsible for any errors or omissions, or for the results obtained from the use of this information. All information in this site is provided “as is”, with no guarantee of completeness, accuracy, timeliness or of the results obtained from the use of this information.
