Effective Immediately

By accessing or participating in any auction hosted by Bill Pelton Livestock Marketing & Consulting (“Pelton Livestock”), users agree to the following Terms & Conditions. These terms form a legally binding agreement between the bidder, buyer, or seller and Pelton Livestock.

1. Legal Agreement

By registering, bidding, or purchasing, users acknowledge that they are entering into a binding contract with the seller. All bids are considered legally binding offers to purchase.

2. Registration & User Responsibility

  • Users must be 18 years or older to register and bid.
  • Registration requires accurate, current information. Users are responsible for maintaining their account credentials.
  • All actions taken under a registered account — including bids, purchases, and payment obligations — are the sole responsibility of the account holder.

3. Financial Arrangements & Invoicing

Pelton Livestock does not process payments or handle financial transactions. All financial arrangements are strictly between the buyer and the seller.

When a buyer wins a lot, they receive an email with complete purchase details, including seller contact and remittance instructions. Sellers are responsible for confirming payment before delivery — animals or merchandise will not be released until payment is received in full.

Pelton Livestock provides sellers with reporting tools, including draft invoices. After review and any necessary adjustments (e.g., credits, shipping charges), final invoices are sent to buyers with clear instructions to remit payment directly to the seller.

4. Personal Data & Consent

Pelton Livestock collects and uses personal data solely for auction operations and future promotions. Data will not be sold or shared with third parties outside of these purposes. Users may revoke consent at any time by emailing info@billpelton.com. See our Privacy Policy for full details.

5. Reserve Price

  • Lots may have a reserve price, which is not disclosed.
  • If the reserve is met, the lot will sell to the highest bidder.
  • If not met, the lot will not be sold during that auction.

6. Bidding Eligibility

  • Pelton Livestock and sellers reserve the right to reject any bid.
  • On reserved items, Pelton Livestock may bid on behalf of the seller up to the reserve price.

7. Currency

All bidding increments and payments are in U.S. Dollars (USD).

8. Liability & Risk

  • Risk transfers to the buyer once the lot is bid off.
  • Sellers will care for animals or merchandise for a reasonable time post-sale.
  • Pelton Livestock acts solely as a medium between buyer and seller and is not liable for fulfillment, warranties, or financial obligations.
  • Catalog data is provided by sellers and assumed accurate but not guaranteed.

9. Technology Disruptions

Pelton Livestock is not responsible for internet failures, software errors, or bidding disruptions. In the event of a technology issue, Pelton Livestock reserves the right to continue, cancel, or suspend the auction.

10. Governing Law & Dispute Resolution

This agreement shall be governed by the laws of the State of Texas.

Any dispute, claim, or controversy arising out of or relating to this agreement, the auction process, or any transaction shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Dallas County, Texas, and judgment on the award may be entered in any court with jurisdiction.

By participating, users waive their right to bring claims in court or have disputes heard by a judge or jury, except to enforce the arbitration award. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
